These Terms and Conditions ("Agreement") govern the use of the job board platform accessible at www.epiic.in ("Platform"), operated by EPIIC Skill Tech Private Limited, a company incorporated under the Companies Act, 2013 having its registered office in India ("Company", "EPIIC", "we", "our", or "us").

By accessing, browsing, or using the Platform, the User (defined below) agrees to be legally bound by the terms and conditions set forth herein. If you do not agree to these terms, please refrain from using the Platform.

1. DEFINITIONS

  1. 1.2. "Job Seeker" shall mean any individual registering on the Platform seeking employment, internship, or related opportunities.
  2. 1.3. "Employer" shall mean any corporate entity, organisation, or institution registered on the Platform for the purpose of posting job opportunities or hosting virtual events.
  3. 1.1. "User" shall mean any natural or legal person, including but not limited to Job Seekers, Employers, Educational Institutions, and other visitors, who access or use the Platform.
  4. 1.4. "Educational Institution" shall mean colleges, universities, or other academic organisations registered on the Platform.
  5. 1.5. "Services" shall mean any product or service offered through the Platform, including free and premium services.
  6. 1.6. "Credits" shall mean the virtual currency issued by EPIIC for transacting on the Platform.

2. ELIGIBILITY AND REGISTRATION

  1. 2.1. By using the Platform, the User represents and warrants that they are competent to enter into a legally binding contract under applicable laws of India.
  2. 2.2. Registration on the Platform requires submission of accurate and complete information and completion of email and OTP verification.
  3. 2.3. Users are responsible for maintaining the confidentiality of their login credentials and are fully responsible for all activities under their account.

3. SERVICES AND USAGE

  1. 3.1. The Platform facilitates:
    1. Direct or assisted job posting and event posting by Employers;
    2. Participation in virtual job fairs and events;
    3. Access to premium services.
  2. 3.2. EPIIC may, at its sole discretion, verify posted jobs or events through a basic verification process. However, EPIIC does not guarantee the authenticity, accuracy, or validity of such postings.
  3. 3.3. Users shall conduct their own due diligence prior to engaging in any transaction, employment, or opportunity posted on the Platform.
  4. 3.4. Any Service availed by the User, once initiated or consumed either partially or fully, shall be considered delivered and non-refundable.

4. PAYMENT TERMS AND CREDIT SYSTEM

  1. 4.1. All paid services on the Platform shall be availed through the internal Credit system. Users may purchase Credits through third-party payment gateways integrated with the Platform.
  2. 4.2. EPIIC reserves the right to determine pricing and to change the cost of Services and Credits at its discretion.
  3. 4.3. No refund shall be entertained under any circumstances for purchased Credits or Services, whether utilized or not.

5. DATA COLLECTION, PRIVACY, AND COMMUNICATION

  1. 5.1. By registering on the Platform, the User provides consent to receive transactional and promotional communication via email, SMS, and WhatsApp.
  2. 5.2. Sensitive personal information may be collected when the user opts in for premium services.
  3. 5.3. Such data shall be stored securely within servers located in India and shall not be disclosed to third parties without express consent of the User, unless required by law.
  4. 5.4. The Company shall comply with applicable Indian data protection and privacy laws, including the Information Technology Act, 2000 and any amendments or rules thereunder.

6. CONTENT OWNERSHIP AND USER OBLIGATIONS

  1. 6.1. Users are solely responsible for the content they post on the Platform. By submitting any content, Users grant EPIIC a non-exclusive, royalty-free, worldwide license to use, reproduce, publish, and display such content on the Platform.
  2. 6.2. EPIIC reserves the right to remove, suspend, or moderate any content at its sole discretion if found to be inappropriate, unlawful, or in violation of these Terms.
  3. 6.3. Users agree not to:
    1. Post false, misleading, or fraudulent content;
    2. Impersonate any person or entity;
    3. Infringe any intellectual property or privacy rights;
    4. Use the Platform for any unlawful activity.

7. LIMITATION OF LIABILITY

  1. 7.1. EPIIC provides the Platform on an "as is" and "as available" basis. The Company does not guarantee uninterrupted, error-free, or secure access to the Platform.
  2. 7.2. Under no circumstances shall EPIIC be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of the use or inability to use the Platform.
  3. 7.3. EPIIC disclaims all liability with respect to the authenticity, accuracy, legality, and reliability of job / event postings, employer representations, or candidate applications.

    4. 8. Dispute Resolution and Governing Law

    1. 8.1. Any dispute arising out of or in connection with these Terms shall be resolved through arbitration in accordance with the Arbitration and Conciliation Act, 1996.
    2. 8.2. The seat and venue of arbitration shall be Chennai, Tamil Nadu, and the arbitration proceedings shall be conducted in English.
    3. 8.3. This Agreement shall be governed by and construed in accordance with the laws of India.

    9. Modification of Terms

    1. 9.1. EPIIC reserves the right to amend, modify, or update these Terms at any time without prior notice. Updated Terms shall be posted on the Platform, and continued use constitutes acceptance of such changes.

    10. Use of Communication Channels

    Users agree to use Platform communication features (email, chat, notifications) responsibly. Any spam, abuse, unsolicited promotion, or harassment may result in account suspension or legal action.

    11. Intellectual Property Rights

    1. 11.1. All intellectual property rights, including but not limited to trademarks, service marks, logos, content, designs, software, and other proprietary materials displayed on the Platform are the sole and exclusive property of EPIIC or its licensors, unless expressly stated otherwise.
    2. 11.2. Logos, names, or trademarks of third parties including but not limited to Employers and Educational Institutions used on the Platform remain the exclusive property of their respective owners. Use of such intellectual property by EPIIC does not confer any rights upon EPIIC, and such materials are used solely for identification or representational purposes.
    3. 11.3. Users agree not to use, copy, reproduce, modify, or distribute any proprietary content from the Platform without prior written authorization.

    12. Termination and Suspension of Account

    1. 12.1. EPIIC reserves the right to suspend or terminate the account of any User at its sole discretion, without notice, if it determines that the User has violated these Terms or engaged in misconduct or fraudulent activity.
    2. 12.2. Upon termination, all rights granted to the User under these Terms shall cease, and EPIIC may delete or disable access to the User’s account and content. However, certain obligations, such as indemnity, limitation of liability, and intellectual property rights, shall survive such termination.

    13. Force Majeure

    EPIIC shall not be held liable for failure to perform or delay in performing its obligations under this Agreement due to events beyond its reasonable control, including but not limited to acts of God, war, riots, pandemics, cyber-attacks, and governmental actions.

    14. Indemnity

    Users agree to indemnify, defend, and hold harmless EPIIC, its affiliates, directors, officers, and employees from and against any claims, liabilities, damages, losses, or expenses arising out of their misuse of the Platform or breach of these Terms.

    15. Third-Party Links and Integrations

    The Platform may contain links or integration with third-party websites and services. EPIIC does not endorse or assume responsibility for any such third-party content or services.

    16. Retention and Deletion of Data

    1. 16.1. User data, including but not limited to registration details, content submissions, and verification documents, shall be retained indefinitely by EPIIC unless the User expressly requests deletion of such data.
    2. 16.2. Upon such request, EPIIC shall delete the data subject to applicable legal and regulatory requirements mandating retention.

    17. Disclaimer of Warranties

    EPIIC disclaims any warranties, express or implied, regarding the performance or outcomes of using the Platform. This includes but is not limited to guarantees of job placement, employer conduct, or candidate competence.

    18. Taxes and Charges

    All prices indicated on the Platform are exclusive of applicable taxes unless stated otherwise. Users shall be solely responsible for all applicable taxes arising from their transactions on the Platform.

    19. Final Provisions

    1. 19.1. These Terms constitute the entire agreement between the User and EPIIC with respect to the subject matter herein and supersede all prior agreements, representations, and understandings.
    2. 19.2. If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
    3. 19.3. No waiver by EPIIC of any breach or default under these Terms shall be deemed to be a waiver of any preceding or subsequent breach or default.
    4. 19.4. The headings used in this Agreement are for reference purposes only and shall not affect the meaning or interpretation of the Agreement.
